1. Acceptance of Terms

By creating an account, browsing, or accessing any service on this platform, you agree to be legally bound by these Terms of Service, our Privacy Policy, and all supplemental policies (including our Reality Show Terms, Contest Rules, Live Stream Policy, and Wallet Terms). If you do not agree to these terms, you must discontinue use immediately.

2. Binding Individual Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and the Platform agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or your use thereof shall be resolved exclusively through final and binding individual arbitration administered by an established arbitration body (such as the American Arbitration Association under its Consumer Arbitration Rules), rather than in a court of general jurisdiction.

The arbitrator shall have exclusive authority to resolve all disputes regarding interpretation, enforceability, or formation of this contract. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

3. Class Action & Jury Trial Waiver

YOU AND THE PLATFORM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Unless both you and the Platform agree otherwise in writing, no arbitrator or judge may consolidate more than one person's claims, nor preside over any form of representative or class proceeding. YOU AND THE PLATFORM EXPRESSLY AND KNOWINGLY WAIVE ALL RIGHTS TO A TRIAL BY JURY.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

UNDER NO CIRCUMSTANCES WILL THE PLATFORM'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO THE PLATFORM IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

5. Indemnification

You agree to defend, indemnify, and hold harmless the Platform, its parent companies, subsidiaries, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with: (a) your access to or use of the platform; (b) your user content, broadcasts, contestant auditions, or contest submissions; (c) your violation of these Terms or any applicable law; or (d) any dispute between you and another user.

6. Disclaimer of Warranties ("AS-IS")

THE PLATFORM AND ALL CONTENT, FEATURES, LIVESTREAMS, CONTESTS, AND REALITY SHOW SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

7. Account Termination & Forfeiture

The Platform reserves the right, in its sole and unfettered discretion, to suspend, disable, or terminate any user account, content, or access at any time, with or without notice, for conduct that violates these Terms or harms other users or the platform's reputation. In the event of account termination for fraud or violation of policies, all unredeemed credits, votes, and virtual gifts are forfeited without refund.

8. Severability & Entire Agreement

These Terms, together with our Privacy Policy and supplemental rules, constitute the entire agreement between you and the Platform. If any provision is deemed unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of any remaining provisions.
